A National Guardsman has filed suit against North Charleston Police alleging civil rights violations during his 2008 arrest, .
The suit brings in race into question because the soldier is black and the arresting officer is white.
Brian Knite Yates, 28, of Ladson alleges he was illegally arrested during a 2008 traffic stop where he was also hit with a stun gun. The trial began this week.
According to the Associated Press, the police report said Yates was pulled over because of loud music, and he was stunned he turned away as though he were leaving.
