Bennett Sworn in for SC Senate 38 Seat

After a primary battle and a court battle, Sen. Sean Bennett heads to Columbia.

Sen. Sean Bennett has been sworn in as S.C. Senator for District 38 during a Monday evening ceremony at Summerville Town Hall.  Bennett scored a decisive win against incumbent Sen. Mike Rose in the GOP primary in June only to be caught up in a Democratic-led lawsuit against his party questioning his and other non-incumbent candidates' legitimacy just a few weeks later.  While the judge ruled Bennett had filed correctly, despite missing a crucial document, his GOP rival Rose didn't give up the fight and appealed the decision to the S.C. Supreme Court. SC Supreme Court Dismisses Case Against Bennett

Sean Bennett certified as S.C. Senate District 38's nominee.

The matter is officially settled: Sean Bennett will go into the November election as the uncontested, certified GOP nominee for S.C. Senate District 38. Wednesday, the S.C. Supreme Court dismissed the appeal case claiming S.C. Senate District 38 GOP nominee Sean Bennett filed improperly on grounds that it should be a matter settled by the state party in executive committee. The appeal was made by his primary opponent incumbent Sen. Mike Rose, who lost to Bennett. "We find this action was improperly commenced in the circuit court since none of the parties attempting to protest the results of the primary exhausted the remedies set forth by the General Assembly," the dismissal wrote. Rose Appeals Bennett's Candidacy to SC Supreme Court

S.C. District 38 GOP nominee won't get respite before going into Aug. 15 certification deadline.

S.C. Senate District 38 GOP nominee Sean Bennett had little more than 24 hours, following a Thursday court decision, to be the uncontested candidate going into the November election. But his Republican primary opponent and incumbent for the seat Sen. Mike Rose filed an appeal Friday that alleges Bennett did not follow S.C. election law when filing. Within the motion to appeal, there is a motion to expedite since the deadline for candidates to be certified for the November ballot is noon Aug. 15.  Rose and Bennett filed motions to intervene in the recently concluded Dorchester County Democratic Party v. Court 'Declines to Disenfranchise' Voters, Keeps Bennett on Ballot

Judge orders that S.C. Senate District 38 GOP nominee Sean Bennett will remain on November ballot.

Judge Howard King ruled Thursday that S.C. Senate District 38 GOP nominee Sean Bennett is the voters' choice and rightful nominee heading into an uncontested November election. The order is attached to the right of this story. Bennett's campaign was questioned in a Dorchester County Democratic Party lawsuit, which questioned all county GOP non-incumbent candidates on proper filing proceedure. Bennett won with more than 60 percent of the vote against incumbent Sen. Mike Rose on June 12. "The Court declines to disenfranchise the voters of Dorchester County," the order that reinstates Bennett reads. GOP Chair: Representations by Piscatella 'Not True'

Dorchester County GOP Chair Carroll Duncan officially decertifies three non-incumbent candidates, including nominee for S.C. Senate District 38.

The "dumb luck" cited by Dorchester County Republican elections officer Tony Piscatella, when asked why nearly every non-incumbent candidate filed correctly, may not have been luck at all. Instead, according to party Chair Carroll Duncan in a statement released Tuesday officially decertifying three non-incumbent candidates due to improper paperwork filing, it was a misrepresentation. Citing affidavits and private conversations with Piscatella, Duncan wrote that she has had no choice but to decertify S.C. Senate District 38 GOP nominee Sean Bennett, who defeated incumbent Sen. Rose Declines Bennett's Debate Requests in Senate Race

Sen. Mike Rose says no to challenger's call for debates leading up to the primary.

The race is on for S.C. Senate District 38 as challenger Sean Bennett challenged incumbent Sen. Mike Rose to multiple debates leading up to the June primary. But Rose tells Patch he doesn't have time due to his responsibilities in the Senate.  In a press release, Bennett made the challenge to Rose, requesting a series of public debates and proposed five topics: Education, Jobs and the Economy, Leadership, Vision and Effectiveness, the State Pension System, and Roads and Infrastructure. "I am asking Sen. Pat ... it would be nice to go to this GOP Breakfast, but it seems the only people around here who KNOW of these meetings are the GOOD OLE BOYS. Where is the outreach? Where are the GOP functions held? I never see any news about them anywhere. Furthermore, if this Bennett is backed by BIG REALLTY, it will be rather obvious to everyone.
